What is the "No Surprises Act"

The "No Surprises Act" is a law in the United States that took effect on January 1, 2022. It was designed to protect patients from unexpected medical bills, particularly those arising from out-of-network services received at in-network facilities. Prior to this law, patients often received surprise bills when they unknowingly received care from providers not covered by their insurance, especially during emergencies.

Key Provisions of the No Surprises Act

  • Balance Billing Protections: It prohibits out-of-network providers from sending bills for more than the in-network cost-sharing amount for emergency services and certain non-emergency services provided at an in-network facility.
  • Patient Consent for Out-of-Network Charges: Out-of-network providers must inform patients about potential charges and obtain their consent before providing non-emergency services.
  • Dispute Resolution Process: It establishes a process for insurers and providers to resolve billing disputes, known as independent dispute resolution (IDR).
